Section 15A: Review of Orders
Explanation
Section 15A of the Citizenship Act, 1955, was introduced by the Citizenship (Amendment) Act, 2003, and it provides a mechanism for the review of orders made by the Central Government under the Act. The key provisions are as follows:
Application for Review: Any person aggrieved by an order made by the Central Government may, within thirty days from the date of such order, make an application for review of such order.
Extension of Time: The Central Government may entertain the application after the expiry of the said period of thirty days if it is satisfied that the applicant was prevented by sufficient cause from making the application in time.
Final Decision: On receipt of any such application, the Central Government shall make such order as it deems fit, and the decision of the Central Government on such review shall be final.
Relevant Judgments
Mukesh Kumar Ravin vs. The Government of India (2023): This case involved a writ petition seeking a direction to the Central Government to dispose of a review petition filed under Section 15A. The court directed the Central Government to consider the review petition on its merits and pass appropriate orders within a specified timeframe.
These provisions and judgments ensure that the process of reviewing orders under the Citizenship Act, 1955, is handled with due process and fairness, protecting the interests of both the individuals and the nation.
