Constitution of Bharat: Part II: Part 5

  1. State of Bombay vs. F.N. Balsara (1951): This case involved the constitutional validity of the Bombay Prohibition Act, 1949, and its applicability to foreign liquors. The Supreme Court held that the Act was valid and did not infringe upon the fundamental rights of individuals.

  2. Hans Muller of Nuremberg vs. Superintendent, Presidency Jail (1955): This case addressed the rights of foreigners in India. The Supreme Court ruled that foreigners do not have a right to claim Indian citizenship or to stay in India as a matter of right. 

  3. Shanno Devi vs. Mangal Sain (1960): This case involved the interpretation of Article 6 of the Constitution of India, which deals with the citizenship of individuals who migrated to India from Pakistan before the commencement of the Constitution. The Supreme Court held that "ordinarily resident" means residing in India without any serious break.

  4. State of Bombay vs. Rustom Cavasjee Cooper (1960): This case, also known as the "Bombay Plan Case," involved the interpretation of Articles 14 and 19 of the Constitution, which guarantee equality before the law and the right to freedom of speech and expression, respectively. While not directly about citizenship, it had significant implications for the rights of Indian citizens.

  5. State of Maharashtra vs. Manohar Joshi (1983): This case involved the interpretation of Article 19(1)(a) of the Constitution, which guarantees the right to freedom of speech and expression. The Supreme Court held that the State's restrictions on the publication of certain books were unconstitutional.

  6. Sarbananda Sonowal vs. Union of India (2005): This case involved the interpretation of Section 6A of the Citizenship Act, 1955, which deals with migrants from Bangladesh to Assam. The Supreme Court ruled that Section 6A was unconstitutional as it violated Articles 14 (equality before the law) and 21 (right to life and personal liberty) of the Constitution.

  7. Bhanwaroo Khan vs. Union of India (2002): This case addressed issues related to citizenship and the rights of individuals who migrated from Pakistan to India. The Supreme Court held that the migrants were entitled to citizenship under the Citizenship Act, 1955.

  8. Assam Sanmilita Mahasangha vs. Union of India (2014): This case involved the constitutional validity of Section 6A of the Citizenship Act, 1955, and its implications for migrants from East Pakistan (now Bangladesh) to Assam. The Supreme Court upheld the validity of Section 6A but directed the government to ensure that the provisions were implemented fairly and without discrimination. 

  9. Assam Public Works v. Union of India (2019): This case involved the constitutional validity of Section 6A of the Citizenship Act, 1955, which deals with migrants from Bangladesh to Assam. The Supreme Court ruled that Section 6A was unconstitutional as it violated Articles 14 (equality before the law) and 21 (right to life and personal liberty) of the Constitution.

  10. Rupajan Begum v. Union of India (2017): This case addressed issues related to citizenship and the rights of individuals who migrated from East Pakistan (now Bangladesh) to Assam. The Supreme Court upheld the validity of Section 6A but directed the government to ensure that the provisions were implemented fairly and without discrimination.
